Employment laws and regulations at both the state and federal level have grown in number and complexity. In states where tort reform has taken hold, plaintiffs' attorneys have focused upon unemployment claims. These developments have increased the risk of loss related to employment practices. Our objective is to assist clients in the management and minimization of these risks and the resolution of claims with a minimum impact upon ongoing business operations.
Our attorneys provide experienced and expert counsel in risk management, which begins with the preparation of effective employment policies, affirmative action plans, and substance abuse and workplace violence policies. We counsel human relations professionals employed by our clients regarding hiring policies and procedures. We serve as human relations resources for those clients without departments devoted to human relations.
We regularly practice and counsel before EEOC and state and local human rights departments in areas which include claims of discrimination based upon race, sex, age, disability and non-compliance with family and medical leave laws. We have successfully defended state law contract claims related to employee handbooks and claims for wrongful termination, defamation and intentional infliction of emotional distress alleged to have arisen out of employment termination.
We also counsel clients regarding wage and hour and safety regulations issues at the state and federal level. We maintain expertise in plant closure regulations and other regulatory matters which do not affect most employers on a day to day basis.
